1. Overview
This website (the "Site") is operated by Samir Alejandro Yaghmour ("we," "us," or "our"). By visiting the Site or purchasing from us, you agree to these Terms of Service (the "Terms"), our Refund & Return Policy, our Shipping Policy, and our Privacy Policy, which are incorporated by reference. If you do not agree, please do not use the Site.
PLEASE READ SECTION 14 CAREFULLY. IT CONTAINS A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT AFFECT HOW DISPUTES ARE RESOLVED.
2. Eligibility
You must be at least 18 years old, or the age of majority in your state, to make a purchase. By placing an order, you confirm that you meet this requirement and that the information you provide is accurate and complete.
3. Our Platform
Our store is hosted on Shopify. Payments are processed by third-party payment providers and are subject to their terms. We do not store your full card information.
4. Products and Descriptions
We make every effort to display our products, colors, sizes, and specifications accurately. Colors may vary slightly depending on your screen, and measurements may vary by a small tolerance. Product images are for illustration. We do not guarantee that product descriptions are error-free, and we reserve the right to correct errors at any time.
5. Pricing and Payment
All prices are listed in U.S. dollars. Prices, promotions, and product availability may change at any time without notice. If an item is listed at an incorrect price due to an error, we may cancel the order and issue a full refund, even after an order confirmation has been sent. You agree to pay all charges at the prices in effect when your order is placed, plus applicable shipping and sales tax.
6. Orders
Your order is an offer to purchase. We may accept, limit, or cancel any order, including orders that appear to be placed by resellers or that are flagged for suspected fraud. If we cancel an order after you have been charged, we will issue a full refund to your original payment method.
7. Shipping, Title, and Risk of Loss
Shipping is governed by our Shipping Policy. Title and risk of loss pass to you when the item is delivered to the shipping carrier, but we will help resolve lost or damaged packages as described in our Shipping Policy.
8. Returns and Refunds
Returns and refunds are governed by our Refund & Return Policy. If you have a problem with an order, please contact us at join.ourproject.usa@gmail.com before disputing a charge with your bank — we can usually resolve issues faster directly.
9. Product Care and Use
Silk is a natural, delicate fiber. Please read and follow the care instructions included with your product and shown on its product page. Damage caused by improper washing, bleach, high heat, tumble drying, sharp objects, jewelry, or pets is not covered. Our products are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease or skin condition.
10. Warranty
If your product arrives damaged or defective, it is covered as described in Section 4 of our Refund & Return Policy. EXCEPT AS STATED THERE AND TO THE EXTENT PERMITTED BY LAW, PRODUCTS AND THE SITE ARE PROVIDED "AS IS." ANY IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO 30 DAYS FROM DELIVERY. Some states do not allow limitations on how long an implied warranty lasts, so this limitation may not apply to you.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE, OUR OWNERS, EMPLOYEES, SUPPLIERS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR ANY PRODUCT. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be limited under applicable law. Some states do not allow these limitations, so they may not apply to you.
12. Indemnification
You agree to indemnify and hold us harmless from claims, losses, and expenses, including reasonable attorneys' fees, arising from your breach of these Terms or your violation of any law or the rights of a third party.
13. Intellectual Property and Site Use
All content on the Site, including text, images, videos, logos, and design, is owned by us or our licensors and protected by intellectual property laws. You may not copy, reproduce, or use it for commercial purposes without our written permission. You agree not to use the Site for any unlawful purpose, to interfere with its security, or to submit false information. Reviews and comments you submit must be truthful and based on your own experience, and you grant us a non-exclusive, royalty-free license to display them.
14. Dispute Resolution, Binding Arbitration, and Class Action Waiver
Informal resolution first. Before starting any formal proceeding, you agree to contact us at join.ourproject.usa@gmail.com and give us 30 days to try to resolve the dispute informally.
Arbitration. If we cannot resolve the dispute informally, you and we agree that any dispute arising from these Terms, the Site, or any product purchased from us will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs this agreement. For claims under $10,000, we will reimburse your AAA filing fees, and the arbitration may be conducted by phone, video, or in writing. The arbitration will take place in the county where you live or in Collin County, Texas, at your choice.
Exceptions. Either party may bring an individual claim in small claims court if it qualifies, and either party may seek relief in court for infringement of intellectual property.
Class action waiver. YOU AND WE AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
Opt-out. You may opt out of this arbitration agreement by emailing join.ourproject.usa@gmail.com with the subject line "Arbitration Opt-Out" within 30 days of your first purchase, including your name and order number.
15. Governing Law
These Terms are governed by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict-of-law rules. Subject to Section 14, any court proceedings will take place in the state or federal courts located in Collin County, Texas.
16. Third-Party Links
The Site may contain links to third-party websites. We are not responsible for their content or practices.
17. Changes to These Terms
We may update these Terms from time to time by posting the revised version on this page. The version in effect when you place an order applies to that order.
18. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with the policies referenced above, are the entire agreement between you and us regarding the Site and your purchases.
